Talent sourcing in mainland China: the 2026 market report
Sourcing in mainland China is a Mandarin-language discipline bounded by two hard constraints: how candidate data may leave the country, and whether the candidate is contractually free to move at all. This report sets out both.
Key facts
- Personal information leaves the mainland through a security assessment, a standard contract with filing, or certification, unless an exemption applies.
- The certification measures took effect on 1 January 2026; further regulator guidance followed in July 2026.
- Outreach runs in Mandarin and Simplified Chinese; an approach that reads as translated reads as unserious.
- Post-employment non-competes are enforceable for a limited period and only where the former employer keeps paying compensation.
- MOHRSS issued compliance guidelines on implementing non-competition restrictions in September 2025.
The data question comes first
For sourcing, named candidates are the point of the exercise, so the cross-border position cannot be deferred the way it sometimes can for aggregated intelligence work.
Under the Personal Information Protection Law and the Cyberspace Administration of China’s provisions, personal information leaves the mainland through a security assessment, a standard contract accompanied by a filing, or certification, unless an exemption applies. The certification measures took effect on 1 January 2026 and the regulator published further guidance on administrative policy in July 2026.
Reported volume thresholds differ between secondary summaries and data classified as important triggers assessment regardless of volume. The route therefore gets agreed in writing with counsel before fieldwork, not negotiated at delivery when the research has already been done.
Language and channel
Outreach runs in Mandarin, written in Simplified Chinese, unless the individual record says otherwise. The relevant population for most mainland roles does not respond to English-language approaches, and an approach that reads as translated carries the same signal everywhere: that the sender does not know this market.
Channel practice is distinct from the rest of our coverage. Professional networking platforms occupy a different position in China from the one they hold in Europe or Singapore, and the channels that actually reach senior engineers are not the ones a Western sourcing playbook would reach for.
Screening is conducted in Chinese and reported in English with the original retained. Where business English is genuinely required for the role it is tested explicitly, because self-reported English level on a Chinese CV is among the least reliable fields on it.
Non-competition: findable is not the same as free
Post-employment non-competition restrictions are a routine feature of senior and technical Chinese employment contracts, and they are enforceable — within limits that matter.
Those limits are that the restriction runs for a capped period and only operates where the former employer continues to pay compensation during it. The Ministry of Human Resources and Social Security issued compliance guidelines on implementing non-competition restrictions in September 2025.
For sourcing this is a planning fact rather than a blocking one. A candidate who is interested and restricted is a different problem from one who is not interested, and the two should never appear identically in a report. We establish the position during screening and record it as its own field.
City choice is a live variable
Capability is distributed unevenly and deliberately. Software and hardware engineering concentrate in Shenzhen, Beijing and Hangzhou; automotive and semiconductors in Shanghai and the Jiangsu cluster; cost-advantaged engineering in Chengdu, Xi’an, Wuhan and Hefei.
Pay differs materially between them, and municipal talent subsidy programmes compete openly to move senior specialists from one city to another. That makes location a variable a sourcing strategy can actually use, rather than a fixed input it has to accept.
The national wage release reports province and region but not city, so city-level pay comparisons have to come from the municipal yearbooks or from primary research. Substituting the provincial number understates coastal cities and flatters inland ones.
How a China sourcing engagement should be priced
Per project, on the research, with nothing contingent on a hire. The Interim Regulation on the Human Resources Market makes intermediary activity — recommending candidates to employers, running job fairs — a licensed business, while information collection and release and consulting and assessment are treated differently.
A research supplier charging a placement fee has changed what business it is in. We produce research and a screened longlist; the client runs selection, offer and close.
Scoping also takes longer here than elsewhere, because the transfer route is settled before fieldwork. That time is not overhead. It is the difference between a deliverable you can use and one that cannot lawfully leave the country.
This report is the market view. If you want the service — scope, process and what it costs — that sits on talent sourcing in mainland China.
China talent sourcing: common questions
Can candidate details leave mainland China?
Only through an agreed route: a security assessment, a standard contract with filing, or certification, unless an exemption applies. The certification measures took effect on 1 January 2026.
For sourcing, named candidates are the deliverable, so the route is agreed in writing with your counsel before fieldwork rather than after.
Does a non-compete stop us approaching someone?
No, but it changes what the approach can realistically lead to and when. Restrictions run for a capped period and only operate where the former employer continues paying compensation.
We record the position per candidate so an interested-but-restricted person is never confused with an uninterested one.
What language should outreach be in?
Mandarin, written in Simplified Chinese, unless the individual record says otherwise. The relevant population for most mainland roles does not respond to English approaches.
Screening is conducted in Chinese and reported in English with the original retained in the file.
Can you source into China for an employer with no local entity?
We can research and source. Whether you can lawfully employ the result without an entity is a question for your counsel and an employment-of-record provider.
We raise it at scoping, because it changes which candidates will engage at all.
